Terms of Use

Welcome to "MiKiMI", a platform connecting amateur models and photographers in Japan. By registering and using our App (iOS, Android, or Web), you agree to the following Terms of Use.

Eligibility

You must be at least 18 years old and must not be enrolled in high school or below to register and use the App. By registering, you confirm that you meet both of these requirements. We reserve the right to request proof of age at any time.

Account Registration

You must register with a valid email address to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you become aware of any unauthorized use of your account.

Nature of the Service

This App is a platform exclusively for creative collaboration between amateur models and photographers. It is not a dating service, matchmaking service, or social networking service intended to facilitate romantic or personal relationships. Any use of the App for purposes inconsistent with this nature — including seeking romantic partners or arranging personal dates — is strictly prohibited and may result in immediate account suspension.

Features

The App provides the following features:

  • Geolocation-based search and matching
  • Chat with other users
  • Search profiles (model & photographer) with filters
  • Upload files (existing photos or direct capture via device camera)
  • Create and manage events (shootings) with other users, including specifying location, date/time, title, price, payer, and recipient

Intellectual Property

All intellectual property rights in the App, including its design, software, and content created by us, remain our exclusive property.

You retain ownership of any photos and content you upload to the App. By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to store, display, and transmit that content solely for the purpose of operating the App and providing its features to other users. This license ends when you delete the content or your account (subject to the data retention period described below).

You may not copy, reproduce, distribute, or create derivative works from our App’s content without our prior written consent.

Prohibited Conduct

When using the App, you agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws or regulations, including Japanese law
  • Posting or sharing false, misleading, or fraudulent information
  • Harassing, threatening, or abusing other users
  • Uploading or sharing content that is offensive, obscene, or infringing on the rights of others
  • Attempting to access accounts or data of other users without authorization
  • Using the App for commercial purposes without our prior written consent
  • Any activity that may disrupt or interfere with the operation of the App
  • Promoting, sharing, or linking to pornographic, illegal, or inappropriate content, including adding links to pornographic websites or illegal material in your profile
  • Impersonating another person or entity

Use of Pictures

  • You may upload and use photos that you own or have full rights to use.
  • You may not upload or use photos owned by others without their explicit written permission.
  • You may not upload photos featuring other individuals without their informed consent. You must respect the portrait rights (肖像権) of any individual photographed. Uploading or sharing photos of others without their explicit consent may constitute a violation of portrait rights under Japanese law.
  • Uploading photos without the consent of the owner or the person depicted is strictly prohibited.
  • The upload of obscene, pornographic, sexually explicit, or otherwise inappropriate content is strictly forbidden. This includes content that is violent, harassing, hateful, or violates the rights or safety of others.
  • Violation of these rules may result in content removal, account suspension, or permanent ban from the platform.

User Information

All personal information in your profile must accurately represent yourself. You must not provide false or misleading information, such as a fake age, name, or other profile details. Impersonating another person or misrepresenting your identity is strictly prohibited and may result in suspension or removal of your account.

Reporting and Moderation

Users may report illegal, inappropriate, or suspicious content or behavior through the App. We reserve the right to investigate, remove content, or suspend accounts at our sole discretion if we believe these Terms or applicable laws have been violated.

Account Termination

We may unilaterally suspend or permanently terminate your account without prior notice if you violate these Terms, applicable laws, or if we determine that your use of the App poses a risk to other users or to the platform. This decision is made at our sole and absolute discretion and is not subject to appeal. You may delete your own account at any time via the account options.

Upon termination, your right to use the App ceases immediately. Data retention after termination is described below.

No Endorsement or Verification

We do not endorse, verify, or guarantee the accuracy, reliability, or legality of any user content, profiles, or communications. Users are solely responsible for their interactions and any consequences thereof.

User Responsibility

You are solely responsible for your interactions and communications with other users, as well as for any content you upload or share on the App. You agree to exercise caution and good judgment when arranging meetings or events. The App does not verify the identity or background of users.

User Disputes

Any disputes or conflicts between users must be resolved directly between the parties involved. We are not responsible for mediating, resolving, or becoming involved in any such disputes.

Disclaimer

The App is provided on an “as is” and “as available” basis. We make no warranties regarding the reliability, accuracy, or availability of the App or its content. We are not liable for any damages, losses, or disputes arising from your use of the App, including but not limited to interactions, meetings, or transactions with other users.

Payments

Currently, all payments are made directly between users outside the App. In the future, we may offer an internal payment system. If you choose to use the App’s payment system (when available), we will facilitate the transaction, but you may still opt for direct cash payment.

Please note: We are not responsible for any non-payment, disputes, or issues that occur when payments are made outside the App.

User Content

You are solely responsible for all content (photos, messages, event details) you upload or share on the App. We do not proactively review or moderate content. However, we reserve the right to remove content that violates these Terms or applicable laws.

Limitation of Liability

The App serves only as a platform to connect users. We are not responsible for the outcome of any meetings, events, or transactions between users, including payments. You use the App at your own risk.

To the fullest extent permitted by applicable law, our total liability for any claim arising from your use of the App shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

Data Storage and Deletion

We store your data (including photos, chat history, and location) on our servers. You may delete your account and data at any time via the account options. After deletion, your data will be retained for up to 2 months to allow for account recovery if you change your mind. After this period, your data will be permanently deleted.

Geographic Scope

The App is currently available only in Japan. We may expand to other countries and languages in the future.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Kanazawa District Court as the court of first instance.

Language

In the event of any conflict or inconsistency between the Japanese and English versions of these Terms, the Japanese version shall prevail.

Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

Changes to the Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or email. Continued use of the App after such changes constitutes your acceptance of the revised Terms.
